Sales Terms

1. Preamble
These Sales Terms ("Sales Terms") govern any in-app purchase made within the mobile application 12 Testers - App community ("the App"), published by:
These Sales Terms supplement the Terms of Service and apply specifically to paid Products offered through the App. By placing an Order, you accept these Sales Terms in full.
2. Definitions
- Buyer: Any User who places an Order from within the App.
- Product: Any digital good or service offered for sale within the App, including Cheese Packs and the 12 Testers Pack.
- Order: A purchase request submitted by the Buyer through Google Play Billing.
- Cheese Pack: A bundle of Cheese (virtual currency) credited to the Buyer's account upon delivery.
- 12 Testers Pack: A service-type Product where Indevo's internal team manually joins the Buyer's Google Play closed testing track as the 12 testers required by Google.
- Google Play Billing: Google's in-app purchase processing system, which is the exclusive payment channel for the App.
3. Available Products
The current Product catalogue and prices are displayed inside the App and may be updated at any time. Two categories of Products are offered:
3.1 Cheese Packs
Cheese Packs deliver a fixed amount of Cheese (virtual currency) to the Buyer's in-app wallet. Cheese can be spent within the App to publish Campaigns, boost Campaigns, or join Cheese Wheel events. Cheese has no monetary value outside the App, cannot be transferred between Users, and cannot be exchanged for real currency.
3.2 12 Testers Pack
The 12 Testers Pack is a manually-fulfilled service. Upon purchase, the Buyer designates one of their Apps; Indevo's internal team then opts in to that App's Google Play closed testing track using twelve Google accounts owned and operated by Indevo, in order to satisfy the 12-tester / 14-day requirement imposed by Google Play.
Limitations:
- One 12 Testers Pack per App, for the lifetime of the App.
- The Buyer must have already configured a closed testing track on Google Play Console for the App.
- Indevo's team uses real Google accounts; the Buyer must make their App available worldwide (or at minimum in Indevo's operating country) for the testers to install it.
4. Order Process
Orders are placed exclusively from within the App via Google Play Billing. The Buyer must:
- Hold an active 12 Testers account.
- Have a Google Play account in good standing in their country of residence.
- Not be flagged for prior refund-after-delivery abuse (see Section 8.3).
The Order is finalised upon Google Play's confirmation of successful payment. Indevo receives an asynchronous notification from Google Play and credits the Cheese (or schedules manual delivery for the 12 Testers Pack) accordingly.
5. Pricing & Payment
All prices displayed in the App are inclusive of all applicable taxes (TTC). Prices may be displayed in the Buyer's local currency, as determined by Google Play's geographic billing rules.
Payment is processed entirely by Google Play. Indevo never accesses, stores, or otherwise handles the Buyer's payment instrument details. Any billing dispute related to the payment channel itself (e.g. unauthorised charge, payment error) must be raised with Google Play directly.
Google Play issues the receipt for the transaction, which serves as proof of purchase.
6. Delivery
6.1 Cheese Packs — Instant Delivery
Cheese is credited to the Buyer's account immediately upon receipt of the payment confirmation from Google Play, typically within seconds. In rare cases of network or backend latency, delivery may be delayed by up to a few minutes.
6.2 12 Testers Pack — Manual Delivery (24h)
The 12 Testers Pack is delivered manually by Indevo's internal team. The committed Service Level Agreement (SLA) is 24 hours from the time of purchase confirmation.
If delivery cannot be completed within the SLA (for example, the Buyer has not configured the closed testing track, or has not made the App available in the relevant country), Indevo will contact the Buyer by email at the address associated with their account.
7. Right of Withdrawal & Statutory Exemption
In accordance with article L221-28 13° of the French Consumer Code, the right of withdrawal does not apply to contracts for the supply of digital content not provided on a tangible medium, where performance has begun with the consumer's prior express consent and acknowledgment of the loss of the right of withdrawal.
7.1 Cheese Packs — Waiver
By placing an Order for a Cheese Pack, the Buyer expressly consents to the immediate execution of the contract (instant crediting of the Cheese balance) and acknowledges losing their statutory right of withdrawal as soon as the Cheese is credited to their account.
7.2 12 Testers Pack — Right of withdrawal and Google Play auto-refund
The 12 Testers Pack is a service Product. The 14-day statutory right of withdrawal applies in principle. However, given the 24-hour delivery SLA (see Section 6.2), Indevo's team may begin opting in to the closed testing track on the Buyer's behalf shortly after purchase. The Buyer may use Google Play's standard 48-hour auto-refund to cancel the purchase before delivery begins.
Once delivery has begun (i.e. testers have started joining the testing track), the Buyer is deemed to have given express consent to begin performance and accepts that the right of withdrawal can no longer fully apply for the portion of service already rendered.
8. Refunds
8.1 Google Play 48-hour Auto-Refund
Google Play offers a self-service refund within 48 hours of any Order. The Buyer can request this refund directly through their Google Play purchase history. Indevo receives a webhook notification from Google Play and processes the consequences on the Buyer's account automatically (see 8.2).
8.2 Indevo's Refund Reconciliation Policy
When Indevo receives a refund notification from Google Play, the following actions are taken automatically on the Buyer's account:
- The Cheese delivered by the refunded Order is debited from the Buyer's wallet (the wallet may temporarily go into negative balance).
- If the refunded Cheese had been spent on a Campaign that has not yet received any Tests, that Campaign is automatically cancelled and remains visible in the Buyer's history with a CANCELLED status.
- If the refunded Cheese had been spent on a Cheese Wheel event that has not yet started (status QUEUE or PREPARATION), the Buyer is automatically removed from that event.
- If the refunded Cheese had been spent on actions that cannot be rolled back (e.g. a Campaign that already has Tests recorded, or an event already in TESTING phase), the corresponding amount is registered as a debt and the account is flagged for refund-after-delivery abuse (see 8.3).
- The Buyer receives both a push notification and a detailed email summarising the impact of the refund on their account.
8.3 Refund-after-delivery Abuse
If a refund leaves a non-recoverable debt on the account (i.e. Cheese was spent on actions that could not be rolled back), or if a 12 Testers Pack is refunded after delivery has begun, the account is flagged. Flagged accounts are blocked from making any future Order until the matter is resolved with the customer support team.
Indevo reserves the right to permanently restrict access to the shop if a Buyer accumulates repeated abusive refunds within a rolling 12-month window.
8.4 Goodwill Refunds
Beyond the cases listed above, the Buyer may contact Indevo's customer support to request a goodwill refund for a 12 Testers Pack that could not be properly delivered due to circumstances beyond the Buyer's control. Such requests are reviewed on a case-by-case basis.

Indevo aims to respond to all written inquiries within 5 business days. Response times for complex matters (e.g. multi-account investigations) may be longer.
10. Consumer Mediation
In accordance with articles L611-1 and following of the French Consumer Code, in the event of a dispute that cannot be resolved amicably with Indevo's customer support, the Buyer (acting as a consumer) may submit the dispute free of charge to a consumer mediator.
Indevo will inform the Buyer of the contact details of the competent mediator upon request to [email protected]. The Buyer may also use the European Online Dispute Resolution platform available at ec.europa.eu/consumers/odr.
11. Modifications to Sales Terms
Indevo may update these Sales Terms at any time. The version applicable to a given Order is the version in force at the time the Order is placed. Significant changes will be communicated via in-app notification and reflected on the "Last updated" date at the top of this page.
12. Governing Law & Jurisdiction
These Sales Terms are governed by French law. Any dispute arising from a purchase, and not resolved through customer support or mediation, shall be submitted to the competent courts of France.
Buyers acting as consumers retain the benefit of the mandatory protective provisions of the law of their country of habitual residence.
